There are different degrees of murder. First-degree murder is a killing that is willful, deliberate, and premeditated. First-degree murder can also include felony-murder, where there is a killing as a result of or in the act of committing a serious felony, such as arson, robbery, burglary, carjacking, kidnapping, mayhem, torture, rape, lewd acts with minor and other sexual offenses.

Capital murder or also known as murder with special circumstances is punishable by death or life in prison without parole (LWOP).

Second-degree murder is a killing that does not involve deliberation or premeditation.

There are other forms of killing, such as voluntary and involuntary manslaughter. Voluntary manslaughter involves killing another person in the “heat of passion,” such as during a heated argument or fight. Involuntary manslaughter involves killing another person without malice or intent to kill, but with conscious disregard for human life.

Vehicular manslaughter usually involves a killing as a result of a car accident. If someone is killed as a result of a car accident where the driver(s) were found to be under the influence of alcohol or drugs, vehicular manslaughter charges can quickly escalate to murder charges. If you were previously convicted of a DUI, and someone is killed as a result of an accident where you were driving under the influence of alcohol or drugs, you will be charged with second-degree murder.

Attempted murder requires an intent to kill and a direct step towards the act of killing, but the act is incomplete and nobody is actually killed. Attempted murder carries a life sentence, so it is just as serious as being charged with the other degrees of murder.
